ARBITRATION

Arbitration is perhaps the oldest method of resolution of disputes still in common use. It is a form of alternative dispute resolution (ADR), a legal technique for the resolution of disputes outside the courts, where the parties to a dispute refer it to an "Arbitral Tribunal", whose decision (the Award) is binding.


It is a settlement technique in which a third party, an impartial adjudicator reviews the case and imposes a decision that is legally binding for both sides.


Arbitration is often used for the resolution of commercial disputes, particularly in the context of international commercial transactions. The use of arbitration is also frequently employed in consumer, construction, intellectual property, carriage/transportation and employment matters, etc.

The number-one benefit of arbitration is that it serves as a forum to resolve disputes outside of the judicial system. Arbitration can be fast, quick and easy, whereas lawsuits can drag on for years and years. The rules of evidence and procedure are usually relaxed in arbitration proceedings.
